Class One Dental Clinic Terms and Conditions

I. General Provisions
1.1 These Terms and Conditions (hereinafter referred to as "the Terms") govern your rights and obligations regarding booking and receiving dental services (hereinafter referred to as "the Services") at Class One Dental Clinic (hereinafter referred to as "the Clinic").
1.2 By making an appointment or receiving services from this clinic in any way (including by telephone, message, online form or in person), you are deemed to have read, understood and agreed to be bound by these terms.
1.3 If you do not agree to all or any part of these terms, please do not book or use any services offered by this clinic.
II. Definition
Unless the context otherwise requires:
2.1 "This clinic" refers to Class One Dental Clinic and its doctors, dental hygienists, staff and authorized representatives.
2.2 “Your Excellency” or “Patient” means any individual who makes an appointment, uses or receives services from this clinic, or a guardian/parent who makes decisions on behalf of a minor or person without capacity for civil conduct.
2.3 "Services" include dental examinations, teeth cleaning, fillings, root canals, extractions, implants, orthodontics, cosmetic dentistry, imaging examinations, and any related care, treatments, or professional advice provided by our clinic.
2.4 "Personal Data" refers to any information that can identify you, including but not limited to your name, contact number, email address, ID card number, medical records, and images.
III. Appointment and Medical Treatment Arrangements
3.1 You may make an appointment by telephone, message, online appointment system (if applicable) or in person at our clinic.
3.2 The appointment time is subject to final confirmation by the clinic. The clinic reserves the right to adjust the appointment time due to doctor's schedule changes, medical equipment arrangements or other reasonable reasons.
3.3 You are responsible for providing true and accurate personal information and contact details when making an appointment, and for notifying the clinic as soon as possible if there are any changes to your information.
3.4 If this is your first visit, you may need to arrive early to complete the registration and medical record form.
IV. Late Arrival, Rescheduling, and Cancellation Policies
4.1 To ensure the smooth operation of all patients' appointments, please notify the clinic as early as possible if you need to change or cancel your appointment (preferably 24 hours in advance).
4.2 If you are late:
Arriving less than 15 minutes late: The clinic will do its best to provide services within the scheduled time, but the actual consultation time may be shortened.
Arriving more than 15 minutes late: The clinic reserves the right to refuse service depending on the circumstances of the day.
Cancel this appointment, or
We will arrange another feasible time for you;
We reserve the right to charge for rescheduling or absence fees (if applicable).
4.3 If you fail to appear at your appointment time without prior notice, the clinic reserves the right to consider it an "absence" and may:
Charge absence fees, and/or
A deposit or partial payment is required for future appointments.
4.4 In the event of a doctor's emergency, medical emergency, severe weather, or other factors beyond the clinic's reasonable control, the clinic reserves the right to change or cancel the appointment and will notify you as soon as possible by phone, SMS, or email and arrange an alternative appointment.
V. Fees, Deposits and Payments
5.1 The service fees of this clinic are based on the price list or individual quotes published by the clinic at that time. The actual cost may vary depending on the individual patient's oral condition and treatment plan.
5.2 For certain treatments or long-term procedures (such as dental implants, orthodontic treatment, etc.), our clinic may require you to pay a deposit or prepay part of the fee before starting treatment.
5.3 Unless otherwise stated in writing, all fees and deposits paid are generally non-refundable. If a treatment plan needs to be changed or terminated due to medical or professional judgment, the clinic will adjust the charges based on the actual services provided.
5.4 You must settle the cost of each visit after the consultation; if you choose to pay in installments or a package, you must pay in accordance with the relevant payment arrangements and dates.
5.5 The payment methods accepted by this clinic are subject to the clinic's announcement at the time (e.g., cash, credit card, electronic payment, etc.).
VI. Insurance and Referrals
6.1 If you have medical insurance, you should proactively contact your insurance company to understand the coverage and claims process. Our clinic can provide receipts or copies of medical records upon request (an administrative fee may apply).
6.2 This clinic makes no guarantee or responsibility regarding the insurance company's approval, compensation amount, or compensation time.
6.3 If, based on professional considerations, a doctor deems it necessary to refer you to another specialist or medical institution, this clinic may provide referral advice, but is not responsible for the service quality, fees, or outcomes of other institutions or doctors.
VII. Medical Information, Consent, and Treatment Risks
7.1 You agree to provide your doctor with complete, truthful and up-to-date medical and health information before receiving any treatment, including known allergies, diseases, medications currently being taken and past treatment experiences.
7.2 The doctor will explain the diagnosis, recommended treatment plan, feasible alternatives, related risks and expected results to you based on professional judgment.
7.3 By signing a consent form, treatment plan or verbally confirming acceptance of treatment, you indicate that you understand the nature, risks, limitations and possible complications of the treatment and are willing to assume reasonable and generally foreseeable treatment risks.
7.4 The results of dental treatment may vary depending on individual physical condition, oral hygiene habits and follow-up. Our clinic does not guarantee that any treatment result will completely meet your subjective expectations.
7.5 The clinic will not be responsible for any consequences or worsening of the condition caused by your failure to follow your doctor's instructions (including follow-up appointment arrangements and home care guidelines).
VIII. Decision-making for children and substitute patients
8.1 Patients under the age of 18 must be accompanied by a parent or legal guardian for their appointments, who must also sign relevant documents and make medical decisions on their behalf.
8.2 When making medical decisions on behalf of other patients (including the elderly, people with mobility impairments, or people with mental capacity), individuals must ensure they are legally authorized and willing to assume corresponding responsibilities.
IX. Personal Data and Privacy
9.1 This clinic collects your personal data primarily for:
Arranging and managing appointments and visits;
Establishing and updating medical records;
Providing appropriate medical services and follow-up;
Contacting and notifying patients regarding clinic arrangements, treatments, or important information;
Complying with legal and regulatory requirements.
9.2 This clinic will take reasonable and appropriate security measures to protect your personal data from unauthorized access, use, modification, or disclosure.
9.3 Except for providing medical services, fulfilling legal responsibilities, insurance claims, or with your consent, this clinic will not sell or provide your personal data to any unauthorized third party.
9.4 You have the right to request access to or correction of your personal data in accordance with applicable law; the clinic may charge a reasonable administrative fee for processing such requests.
10. Limitation of Liability
10.1 To the maximum extent permitted by applicable law, the clinic, its doctors, employees, or agents shall not be liable for any indirect, incidental, special, or consequential damages (including, but not limited to, loss of profits, loss of data, loss of time, or mental distress) arising from the use of or inability to use the clinic's services.
10.2 In any event that the clinic is liable for any claim, the clinic's total liability for such claim shall be limited to the fees you have actually paid to the clinic for the services in dispute (unless otherwise mandated by law).
10.3 This Agreement does not exclude or limit any liability that cannot be excluded or limited by law, including liability for personal injury or death caused by the clinic's gross negligence or intentional acts.
XI. Website and Third-Party Links
11.1 The clinic has an official website or online platform. The information contained on the website is for general informational purposes only and does not constitute any medical or professional advice. For any oral or health issues, you should seek individual advice from a dental or medical professional.
11.2 The clinic's website or communication channels may contain links to third-party websites or services. Such websites or services are not operated by the clinic, and the clinic assumes no responsibility for their content, privacy policies, or conduct.
XII. Compliance with Laws and Regulations
12.1 The operation and services of the clinic are subject to applicable laws and medical regulations of the Hong Kong Special Administrative Region, including regulations concerning private medical institutions and guidelines issued from time to time by relevant regulatory bodies (such as requirements under the Private Healthcare Facilities Ordinance (PHFO)).
12.2 If laws or regulations change, the clinic reserves the right to update its internal policies and these Terms in accordance with the relevant requirements without prior individual notice to you.
XIII. Force Majeure
13.1 The clinic shall not be liable for any loss or inconvenience caused by any event beyond its reasonable control (including but not limited to natural disasters, severe weather, fire, flood, riot, war, outbreaks of infectious diseases, government measures, power or internet outages, etc.) that prevents the clinic from providing services as usual.
13.2 The clinic will restore services and arrange rescheduling for you as soon as practicable.
XIV. Amendments to Terms
14.1 The clinic reserves the right to amend these Terms from time to time. The amended terms will take effect upon posting on the clinic's website/online platform (if any) without further individual notice.
14.2 Your continued booking or use of the clinic's services after the update of these Terms constitutes your agreement to be bound by the amended terms.
XV. Severability and Waivers
15.1 If any provision of these Terms is held invalid or unenforceable by a court of competent jurisdiction, that provision shall be deemed to have been modified or deleted to the fullest extent permitted by law, and the remaining provisions of these Terms shall continue to be in full force and effect.
15.2 The clinic's failure to take immediate action regarding any breach of these Terms shall not be deemed a waiver of its rights to exercise its rights regarding any future or other breaches.
XVI. Governing Law and Dispute Resolution
16.1 These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region.
16.2 Any dispute arising out of or relating to these Terms or the services of the clinic shall first be settled amicably through negotiation; if such negotiation fails, the parties agree to submit the dispute to the exclusive jurisdiction of the courts of Hong Kong.
